ExpiTrans & Troute SMS Messaging Terms and Conditions

These SMS Messaging Terms and Conditions (“SMS Terms”) govern SMS and MMS messages sent by or on behalf of ExpiTrans, Inc. (“ExpiTrans,” “we,” “us,” or “our”), including messages delivered through Troute, an ExpiTrans product, and other ExpiTrans products and services. Troute is a software platform operated by ExpiTrans that may facilitate authentication, account, transaction, invoice, payment, onboarding, booking, customer-care, support, and other service-related communications. Depending on the applicable messaging program, messages may be sent directly by ExpiTrans or on behalf of an identified participating merchant using Troute. By affirmatively enrolling in an applicable recurring messaging program, requesting a one-time authentication message, or otherwise expressly requesting an SMS communication, you agree to these SMS Terms as they apply to that messaging program. Consent to one messaging program, one participating merchant, or one category of messages does not automatically constitute consent to another messaging program, participating merchant, or message category.
1. Program Names
SMS communications may be provided under one or more programs identified as: ExpiTrans SMS Messaging Program and/or Troute SMS Messaging Program — Troute, an ExpiTrans product Participating merchants may also use Troute to send messages identified by both the participating merchant and Troute, such as: Troute for [Merchant Name] ExpiTrans may operate or facilitate separate messaging programs or campaigns for: one-time authentication and two-factor authentication; account and security notifications; transaction notifications; invoice and payment notifications; receipts and payment confirmations; customer or client onboarding and service notifications; booking and appointment notifications; customer care; technical support; operational and service-related communications; and marketing or promotional communications where separately offered and separately authorized. Each messaging program is subject to the consent requirements applicable to that program.
2. Program Description
Depending on the service you use, the participating merchant with whom you interact, the messaging program in which you enroll, or the action you initiate, messages may include: one-time passcodes; multifactor-authentication codes; login verification; account-registration verification; mobile-number verification; password recovery; account-access recovery; account-security alerts; suspected unauthorized-activity alerts; suspected-fraud notifications; account updates; payment confirmations; transaction confirmations; payment receipts; failed-payment notifications; settlement notifications; deposit notifications; batch-status notifications; invoice notifications; invoice reminders; payment reminders; payment-status updates; merchant-account updates; client or customer onboarding communications; document or information requests; application-status updates; booking confirmations; appointment reminders; appointment rescheduling notices; provider or schedule changes; appointment cancellations; customer-care communications; support-ticket communications; technical-support communications; service-availability notifications; operational notices; and marketing or promotional messages where separately and expressly authorized. Messages may be sent using automated technology.
3. Troute Merchant Communications
Participating merchants may use Troute to communicate with their customers, clients, or other authorized recipients. Where applicable, the SMS consent disclosure identifies the participating merchant and explains that messaging is provided through Troute, an ExpiTrans product. For example, a participating merchant may use Troute to send: invoices and invoice reminders; payment confirmations and receipts; payment-status notifications; account or service updates; customer or client onboarding communications; document requests; booking confirmations; appointment reminders; appointment changes; cancellations; and other service-related communications specifically disclosed when consent is obtained. Consent is specific to the applicable participating merchant and messaging purpose. Consent to receive messages from one participating merchant does not automatically constitute consent to receive messages from another participating merchant. Consent to receive one category of messages, such as invoice and payment notifications, does not automatically constitute consent to receive another materially different category of messages, such as marketing messages, unless the recipient separately provides the consent required for that messaging program.
4. Authentication and Two-Factor Authentication Messages
Troute or ExpiTrans may send one-time authentication messages when a user initiates an action such as: creating or verifying an account; requesting a login code; verifying a mobile number; resetting a password; recovering account access; enabling multifactor authentication; or completing another user-initiated account-security action. Authentication messages are sent only after the user affirmatively initiates an action requesting or requiring SMS verification. A typical authentication message may state: Troute: Your verification code is 4829
13. This code expires in 10 minutes. Do not share this code with anyone.
Authentication messages are transactional security messages and are not marketing messages.Authentication Consent Before an SMS verification code is sent, the applicable Troute or ExpiTrans interface requires an affirmative user action requesting SMS verification. The user is provided notice that requesting SMS verification will result in a one-time authentication text message being sent to the applicable mobile number. The interface displays language substantially similar to: By requesting a verification code, you agree to receive a one-time authentication text message from Troute, an ExpiTrans product, at the mobile number associated with your account. Standard message and data rates may apply. The authentication workflow may require the user to select an unchecked SMS-verification checkbox and then select Send Verification Code, Reset My Password, or another clearly identified action that initiates the SMS request. The applicable interface also provides access to the Privacy Policy and Terms and Conditions. ExpiTrans or Troute may record evidence of the authentication request and consent event, including the mobile number, date and time, account, workflow, and applicable consent disclosure. 5. Recurring Account, Invoice, Payment, and Service Notifications
Recipients who affirmatively enroll in an applicable recurring messaging program may receive messages concerning: account activity; transaction activity; invoices; invoice reminders; payment status; payment confirmations; receipts; failed payments; deposits; settlements; account updates; security events; onboarding activity; support matters; or other service-related activity described when consent is obtained. Message frequency varies depending on the applicable program and may be affected by account activity, transaction volume, invoice activity, payment activity, support interactions, and other service events. Enrollment in an optional recurring SMS messaging program is voluntary and is not a condition of purchase. Where recurring SMS is offered as an optional notification channel, the recipient may complete the applicable purchase, transaction, payment, booking, or enrollment without consenting to recurring SMS messages. Providing a mobile telephone number by itself does not constitute consent to receive recurring SMS messages.
6. Booking and Appointment Notifications
Participating merchants may use Troute Booking to send booking and appointment-related SMS communications to customers who affirmatively enroll in the applicable messaging program. These messages may include: booking confirmations; appointment reminders; appointment rescheduling; provider changes; schedule changes; appointment cancellations; booking-status updates; and other service-related booking communications disclosed at enrollment. A customer may complete a booking without agreeing to receive optional recurring SMS notifications. Providing a mobile number while making an appointment does not by itself constitute consent to receive recurring booking-related SMS messages. Where recurring booking-related SMS enrollment is offered, the customer must take a separate affirmative action, such as selecting an SMS-specific checkbox that is unchecked by default.
7. Marketing Messages
Where offered, ExpiTrans or a participating merchant may separately request consent to send marketing or promotional SMS messages concerning: products; services; features; events; educational information; promotions; special offers; or other commercial communications. Marketing messages will be sent only where the level of consent required by applicable law and messaging-provider requirements has been obtained. Consent to receive marketing text messages is not a condition of purchasing any goods or services. Marketing consent is separate from consent to receive authentication, account, invoice, payment, booking, customer-care, support, or other transactional and service-related messages. Consent to a transactional or service-related messaging program does not automatically constitute consent to receive marketing or promotional SMS messages.
8. Consent and EnrollmentRecurring SMS Programs
Recurring SMS consent is obtained through an affirmative action by the recipient. Providing or entering a mobile telephone number by itself does not constitute consent to receive recurring SMS messages. Depending on the applicable program, recurring SMS consent may be provided by: entering or confirming a mobile telephone number and affirmatively selecting a separate SMS-specific consent checkbox that is unchecked by default; submitting another electronic authorization that clearly identifies the applicable SMS program and required disclosures; affirmatively enabling an SMS communication preference within a Troute or ExpiTrans account; texting a supported opt-in keyword where keyword enrollment is expressly offered and properly disclosed; or another documented affirmative-consent process permitted by applicable law and supported by the applicable messaging program. Where a digital SMS checkbox is used: the checkbox is specific to SMS messaging; the checkbox is separate from general Terms and Conditions acceptance; the checkbox is separate from payment authorization; the checkbox is separate from an engagement or service-agreement acceptance; the checkbox is unchecked by default; the recipient is informed of the types of messages being requested; the applicable sender or participating merchant is identified; message frequency is disclosed; standard message and data rate information is disclosed; STOP opt-out instructions are provided; HELP instructions are provided; applicable Privacy Policy and Terms and Conditions links are available; applicable mobile-information privacy disclosures are presented; and the recipient may complete the underlying transaction, booking, payment, or enrollment without selecting the SMS checkbox where recurring SMS is optional. Consent for one messaging program does not automatically authorize a materially different messaging program.One-Time Authentication For one-time authentication messages, the recipient affirmatively requests SMS verification through the applicable authentication or account-security workflow. The authentication SMS is sent only after the recipient performs the disclosed action requesting the message. Evidence of the authentication request and consent event may be retained as described in these SMS Terms and the ExpiTrans Privacy Policy.
9. Public Consent Examples
ExpiTrans maintains a public page containing representative examples of Troute SMS consent and authentication workflows. Examples may include: Troute two-factor authentication; invoice and payment notification enrollment; new-client onboarding enrollment; and booking and appointment notification enrollment. The examples are provided to document representative Troute consent practices. Viewing the documentation page does not enroll a visitor in any SMS messaging program. Actual consent is collected through the applicable Troute or ExpiTrans workflow or other expressly disclosed enrollment mechanism.
10. Message Frequency
Message frequency varies. Message frequency may depend on: the messaging program; account activity; invoice activity; payment activity; transaction volume; authentication requests; security events; booking activity; appointment activity; onboarding activity; support interactions; service events; and recipient communication preferences. For one-time authentication programs, a message is generally sent only in response to an authentication request initiated by the user. For recurring messaging programs, the number of messages depends on the applicable account, transaction, booking, payment, support, or service activity. ExpiTrans does not guarantee or require a fixed number of messages.
11. Message and Data Rates
Standard message and data rates may apply. Your wireless carrier's standard messaging, data, and other charges may apply to messages you send or receive. ExpiTrans does not charge a separate fee solely for receiving an SMS message. Fees may, however, apply to the underlying ExpiTrans, Troute, participating-merchant, payment, booking, or other service. Contact your wireless carrier for information regarding your messaging plan and charges.
12. Opting Out
You may opt out of an applicable recurring SMS messaging program by replying: STOP ExpiTrans or its messaging provider may also recognize other supported opt-out keywords, which may include: CANCEL; END; OPTOUT; QUIT; REVOKE; STOPALL; and UNSUBSCRIBE. After you submit a supported opt-out request, you may receive one final confirmation message stating that your request has been processed. Messages subject to the applicable opt-out or suppression rule will not resume unless the applicable requirements for resubscription are satisfied.Scope of an Opt-Out The technical scope of an SMS opt-out may vary based on: the originating number; messaging program; messaging profile; messaging provider; participating merchant; carrier requirements; and applicable system configuration. In some configurations, replying STOP may suppress messages from more than one number associated with the same messaging profile or program. ExpiTrans and Troute honor applicable STOP requests and messaging-provider suppression requirements. Because suppression may operate at the sender, profile, or provider level, an opt-out may also prevent delivery of subsequently requested SMS messages, including security or authentication messages, until the recipient validly resubscribes or the applicable suppression rule is otherwise removed in accordance with messaging-provider requirements. If SMS delivery is unavailable because of an opt-out or suppression rule, an alternative authentication or communication method may be offered where available. Consent to one program and an opt-out from another are administered according to the applicable messaging-provider and program configuration.
13. Resubscribing
Where supported and permitted, you may resubscribe to an SMS messaging program by: completing a new consent process; affirmatively updating your SMS communication preferences; replying START; replying UNSTOP; or using another resubscription method expressly offered for the applicable program. Resubscription is subject to the applicable carrier, messaging-provider, and program requirements. A new or updated consent record may be created before messages resume. Resubscribing to one program does not automatically enroll you in unrelated messaging programs.
14. Help and Customer Support
For assistance with an SMS messaging program, reply: HELP You may also contact: ExpiTrans Support Telephone: 888-270-3642 Email: support@expitrans.com A HELP response may include information concerning: the ExpiTrans or Troute brand; the participating merchant where applicable; the applicable messaging program; customer-support options; standard message and data rates; applicable messaging frequency; and opt-out instructions.
15. Supported Carriers and Message Delivery
Message delivery is subject to: wireless-carrier availability; network availability; device compatibility; device settings; telephone-number accuracy; carrier filtering; messaging-provider availability; opt-out or suppression rules; service outages; and other conditions outside ExpiTrans's reasonable control. Wireless carriers are not liable for delayed or undelivered messages. ExpiTrans does not guarantee that: every message will be delivered; every message will be delivered immediately; every mobile device will be compatible; every carrier will support every feature; or messaging services will be uninterrupted.
16. Mobile Telephone Number Responsibilities
By providing a mobile telephone number in connection with an SMS program, you represent that: you are the subscriber, customary user, or authorized user of the number; you are authorized to request or consent to messages at that number; the number is accurate; the number is current; and you will update your information or notify the applicable party if your authority to use the number changes. You should update your account or notify ExpiTrans or the applicable participating merchant if: your mobile number changes; you discontinue the number; you transfer the number; the number is reassigned; you lose access to the number; or you are no longer authorized to use the number. Do not provide a mobile number belonging to another person without authorization.
17. Security of Authentication Messages
Authentication messages may contain sensitive one-time security codes. You should: never share a one-time passcode with another person; use a code only for the authentication request you initiated; disregard an unsolicited authentication code; report suspected unauthorized account activity; protect your mobile device; maintain appropriate account security; and verify that authentication requests originate from an official Troute or ExpiTrans interface. ExpiTrans and Troute will not ask you to disclose a one-time authentication code in response to an unsolicited telephone call, email, or text message. If you receive an authentication code you did not request, do not provide that code to another person.
18. Transactional and Service-Related Messages
Transactional or service-related messages may include: authentication codes; requested account information; payment confirmations; transaction confirmations; receipts; account notices; settlement updates; failed-payment notices; invoice notifications; invoice reminders; payment reminders; security warnings; fraud alerts; client or customer onboarding communications; document requests; booking confirmations; appointment reminders; provider or schedule changes; appointment cancellations; support responses; application updates; and technical-service notices. Receiving a transactional or service-related message does not enroll you in marketing messages unless you separately provide the required marketing consent.
19. Privacy and Mobile-Information Sharing
ExpiTrans processes personal and mobile information in accordance with the ExpiTrans Privacy Policy. Privacy Policy:

Mobile telephone numbers, SMS opt-in information, and SMS consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. This protection includes: mobile telephone numbers; SMS opt-in data; messaging consent; enrollment records; text-messaging originator information; and records showing whether a recipient has consented to a messaging program. ExpiTrans will not share a recipient's opt-in to an SMS messaging program with another party for purposes unrelated to providing the services of the applicable messaging program. ExpiTrans may disclose mobile information to service providers and other parties solely as reasonably necessary to: transmit or deliver requested messages; provide telecommunications or communications infrastructure; operate Troute; provide the applicable participating-merchant service; manage consent; maintain opt-out and suppression records; prevent fraud; protect security; provide customer support; investigate abuse; maintain records; or comply with applicable law. These service providers may include: telecommunications carriers; messaging providers; platform providers; cloud-service providers; security providers; fraud-prevention vendors; and other vendors that assist ExpiTrans in providing the applicable messaging service. Those parties may use mobile information only to provide the applicable services to ExpiTrans, Troute, or the participating merchant, or as otherwise permitted or required by law. Text-messaging originator opt-in data and consent will not be shared with third parties or affiliates for unrelated marketing or promotional purposes.
20. Records of Consent, Messaging Preferences, and Opt-Out Requests
ExpiTrans and Troute may maintain records relating to SMS consent, authentication requests, communication preferences, and opt-out activity. Depending on the applicable workflow, those records may include: the mobile telephone number; the applicable user or customer; the participating merchant; the messaging program or purpose; the consent language presented; the version of the disclosure presented; the source or method of consent; the date and time of consent; the account associated with the request; the applicable Troute workflow; device or IP information where appropriate; authentication requests; keyword requests; opt-out requests; HELP requests; resubscription activity; and other information reasonably necessary to document messaging consent and communication preferences. These records may be retained as reasonably necessary to: administer messaging programs; honor communication preferences; maintain suppression records; document and demonstrate consent; demonstrate compliance; investigate complaints; investigate abuse; protect account security; prevent fraud; and comply with legal, regulatory, contractual, carrier, or messaging-provider requirements.
21. Consent Is Specific and Is Not Automatically Transferable
SMS consent is specific to the applicable sender, participating merchant, messaging purpose, and program presented to the recipient at the time consent is obtained. Consent is not automatically transferable from one independent business, participating merchant, messaging purpose, or campaign to another. A recipient's consent to receive messages from one participating merchant through Troute does not automatically authorize another participating merchant to send messages to that recipient. Similarly: consent to receive invoice and payment notifications does not automatically authorize booking notifications; consent to receive booking notifications does not automatically authorize invoice notifications; consent to receive service-related notifications does not automatically authorize marketing messages; and consent to receive messages from one participating merchant does not automatically authorize messages from another participating merchant. Where appropriate, a single consent disclosure may expressly identify more than one closely related service-message category. In that case, consent applies only to the categories clearly disclosed to the recipient when consent is obtained. ExpiTrans may process, maintain, and administer consent records on behalf of participating merchants as part of providing the Troute platform and messaging services.
22. Changes to Messaging Programs
ExpiTrans may, subject to applicable law, carrier requirements, messaging-provider requirements, and existing consent limitations: modify a messaging program; change a sending number; change a messaging provider; change technical routing; modify operational features; suspend a messaging program; or discontinue a messaging program. Changing a sending number or messaging provider does not expand the purpose or scope of the recipient's existing consent. A material change to the purpose or scope of a messaging program may require additional notice or new consent. Where required, ExpiTrans or the applicable participating merchant will provide the appropriate notice or obtain new consent before materially different messages are sent.
23. Changes to These SMS Terms
We may update these SMS Terms periodically. When these SMS Terms are updated, we will revise the Last Updated date at the top of this page. Where required by applicable law, contract, carrier requirements, messaging-provider requirements, or the nature of a material change, ExpiTrans may provide additional notice or obtain new consent. An update to these SMS Terms does not itself expand the scope of an individual's previously provided SMS consent.
24. Disclaimer
ExpiTrans and Troute SMS messaging services are provided on an “as available” basis. Message delivery may be affected by: carrier availability; network conditions; device settings; blocked numbers; inaccurate telephone information; carrier filtering; messaging-provider filtering; telecommunications outages; software outages; opt-out or suppression rules; fraud controls; security controls; or events outside ExpiTrans's reasonable control. Do not rely exclusively on SMS for emergency communications or other communications where delayed delivery could create an immediate risk to health or safety.
25. Relationship to Privacy Policy and Other Terms
These SMS Terms supplement the ExpiTrans Privacy Policy and applicable ExpiTrans or Troute terms, merchant agreements, service agreements, and other agreements governing the applicable service. ExpiTrans Privacy Policy:

If a participating merchant maintains additional terms, privacy notices, or disclosures applicable to its relationship with you, those terms or disclosures may also apply to the participating merchant's communications and use of Troute. Nothing in these SMS Terms expands the scope of consent actually provided by a recipient through an applicable SMS consent flow.
